In Germany, disability is not assigned as a “group,” but through the Grad der Behinderung, GdB: the degree to which an illness or limitation affects a person’s participation in ordinary life. GdB, additional Merkzeichen markers, and the separate Pflegegrad status determine which rights and compensation can be received, from tax deductions and protection at work to discounted transport, care support, and home adaptations.

The main point for immigrants is that support almost always starts with an application. The authority does not assign the status automatically just because a diagnosis already exists in another country. You need to collect medical documents, submit an Antrag to the responsible authority, and wait for the decision.

What counts as disability under German rules

The basic definition is contained in SGB IX. A person is considered a person with a disability if physical, mental, intellectual, or sensory impairments are highly likely to last longer than six months and, together with barriers, hinder equal participation in public life.

This is not limited to visible mobility restrictions. The basis may include chronic illnesses, consequences of cancer, hearing or vision impairments, mental health conditions, intellectual disabilities, severe consequences of injuries, and other conditions. The decision is made not on the name of the diagnosis, but on how it limits everyday life.

GdB: how the German “degree of disability” works

GdB is measured from 20 to 100, usually in steps of 10. It is not a percentage of work capacity and not a direct equivalent to Russian or Ukrainian disability groups. The German authority assesses the combined impact of all impairments, so several diagnoses are not added up arithmetically.

Practically important thresholds:

GdB What it usually means
20-40 Disability is recognized, but a Schwerbehindertenausweis is usually not issued. Tax Pauschbetraege and some individual compensation may still be possible.
30-40 You can request Gleichstellung through the Agentur fuer Arbeit if the limitation makes it hard to get or keep a job.
50 and above This is Schwerbehinderung, or severe disability. From this threshold, a Schwerbehindertenausweis is issued.
100 The maximum GdB; specific benefits still depend on Merkzeichen and the situation.

Any comparison between GdB and “groups” from other systems is only very rough. For the German authority, recent medical reports, functional limitations, and their duration matter more.

Who can submit an application

The application to establish a GdB is usually submitted by a person who lives, normally resides, or works in Germany. The competent authority depends on the federal state and city: most often it is the Versorgungsamt, Landesamt fuer Soziales, Schwerbehindertenstelle, or another authorized institution.

If you do not know where to apply, start with:

  • the website of the Buergeramt/Sozialamt in your city or Landkreis;
  • your health insurance fund;
  • EUTB counseling at teilhabeberatung.de;
  • the social service of a hospital or rehabilitation center;
  • your family doctor: contact your family doctor.

For children with disabilities, the application is submitted by parents or legal representatives. If the child attends school, it is also worth clarifying school support in parallel: children with disabilities can study in public schools, but the format of support depends on the state, the school, and specialist assessments.

Schwerbehindertenausweis: what the ID card provides

Schwerbehindertenausweis is the ID card of a person with severe disability. It is issued for GdB 50 and above. The document states the GdB, the validity period, and special Merkzeichen markers if the authority recognized them.

The ID card by itself is not a “pension” and does not mean an automatic monthly payment. It confirms the right to Nachteilsausgleiche, compensation for disadvantages caused by disability. This may include labor guarantees, tax benefits, transport concessions, the right to an accompanying person, parking permits, or a reduced Rundfunkbeitrag.

Behindertenausweis usually looks like a plastic card with a photo, GdB, and markers. Older paper ID cards may continue to be valid if their term has not expired and the authority has not required a replacement.

The ID card is usually limited to a term of up to five years. If no substantial improvement is expected, it may be issued indefinitely. For children and for people with a temporary residence permit, the term may depend on age or on the duration of the Aufenthaltstitel.

Merkzeichen: which markers exist

Merkzeichen do not indicate a diagnosis but additional functional limitations. Specific benefits depend on them.

The exact combination of benefits must be checked for your Merkzeichen. Two people with the same GdB but different markers may have different rights.

How to establish disability status: step by step

1. Collect medical documents

You need documents that show not only the diagnosis, but also the limitations in life:

  • reports from doctors and specialists;
  • discharge summaries from hospitals and rehabilitation;
  • test results;
  • a list of medications and assistive devices;
  • reports from a psychotherapist, speech therapist, occupational therapist, or physiotherapist if they matter;
  • for children, reports from an SPZ, school, Kita, Jugendamt, or Fruehfoerderstelle, if available.

Foreign documents are best translated into German, especially if they are key documents. Older documents can be attached, but recent German medical reports are usually decisive.

2. Find the responsible authority

In different states, the procedure may be called Antrag auf Feststellung einer Behinderung, Schwerbehindertenantrag, or something similar. In many regions, the application can be completed online, but paper submission is also often available.

If you found a portal such as schwerbehindertenantrag.de, use it only as an entry point and check that it leads to your federal region or to the official authority.

3. Complete the Antrag

The application usually asks for:

  • personal data and address;
  • doctors, hospitals, and therapists who can provide information;
  • illnesses and limitations;
  • already recognized Pflegegrad, accident insurance, or other decisions;
  • a request to establish GdB and, if applicable, Merkzeichen.

It helps to describe limitations concretely: not “my back hurts,” but “I can stand for 10 minutes, cannot climb stairs without stopping, and need help with shopping.” The authority assesses the consequences for everyday life.

4. Wait for the review

The authority requests information from doctors or asks for additional documents. Sometimes a medical examination is scheduled, but often the decision is made based on paperwork. Timelines vary greatly, from a few weeks to several months. If documents are missing or doctors respond slowly, the process takes longer.

5. Check the Bescheid

After the review, you receive a Feststellungsbescheid. It states the GdB, the date from which recognition applies, and the Merkzeichen. If the GdB is 50 or higher, a Schwerbehindertenausweis is issued separately or you are asked to submit a photo for the card.

If the decision seems too low, you can file a Widerspruch within the deadline stated in the Bescheid. Before objecting, it is better to get advice, because with a new review the authority examines the case again from the beginning.

If GdB is 30 or 40: Gleichstellung for work

People with GdB 30 or 40 can apply to the Agentur fuer Arbeit for Gleichstellung mit schwerbehinderten Menschen. This equal treatment with severe disability is needed not “for all benefits,” but primarily to protect a job or improve the chances of getting suitable employment.

Gleichstellung can help with:

  • special protection against dismissal;
  • support for the employer when adapting the workplace;
  • counting toward the employment quota for people with disabilities.

But it does not grant all the rights of a Schwerbehindertenausweis. For example, extra vacation and free transport usually remain tied to severe disability and specific markers.

Benefits at work

Protection against dismissal

For people with recognized severe disability, dismissal usually requires the consent of the Integrationsamt. This is not a total ban on dismissal: the authority reviews the circumstances and may agree. But the employer cannot simply bypass this procedure if the protection applies.

This protection has conditions and exceptions, for example during the first months of employment or under certain special contracts. So if dismissal is a threat, it is better to quickly contact the Betriebsrat, Schwerbehindertenvertretung, a union, a lawyer, or an advisory center.

Additional vacation

Under Section 208 SGB IX, an employee with severe disability is entitled to extra paid leave. With a five-day workweek, this is usually 5 working days per year. If the workweek is shorter or longer, the number of days is recalculated proportionally.

Workplace adaptation

Support may be available for technical aids, special equipment, access to the workplace, assistance, training, or subsidies for the employer. Funding sources depend on the situation: Integrationsamt, Agentur fuer Arbeit, pension insurance, accident insurance, or other rehabilitation providers.

Specialized workshops, Inklusionsbetriebe, and the regular labor market may be used for finding work or training. The decision depends on the person’s abilities, wishes, and medical recommendations.

Tax benefits

Germany applies the Behinderten-Pauschbetrag, a tax lump sum for people with disabilities. It depends on the GdB and is claimed in the tax return or through the Lohnsteuer-Ermaessigungsverfahren. Since 2021, the Pauschbetrag starts already from GdB 20.

The rough logic is this: the higher the GdB, the higher the Pauschbetrag; for markers H, Bl, TBl, and some Pflegegrad cases, special rules apply. Because the tax amounts and the form of the application belong to tax law, it is worth checking the current table on the Finanzamt website or with a tax adviser before filing.

Additional expenses may also be recognized for treatment, care, trips, home adaptation, or vehicle modification. Not all expenses are accepted automatically, so keep invoices and Bescheide.

Transport, car, and parking

Transport benefits depend on the Merkzeichen and on a Beiblatt with Wertmarke.

The most common important options are:

  • with certain Merkzeichen, you may obtain the right to free or discounted travel on public transport with a Wertmarke;
  • an accompanying person with marker B may travel free of charge under the carrier’s rules;
  • with aG or Bl, you may apply for a European parking permit for disabled parking spaces;
  • with some markers, a discount or exemption from Kfz-Steuer is possible.

If you are planning to buy a car, check the rules of the Hauptzollamt and the Strassenverkehrsamt in advance. Benefits are usually tied to the person in whose name the vehicle is registered and who actually uses it.

Support for families, children, and education

A child’s disability may affect:

  • support in Kita and school;
  • Schulbegleitung or Integrationshilfe;
  • Pflegegrad and benefits from long-term care insurance;
  • tax benefits for parents;
  • Kindergeld after adulthood if the child cannot support themselves because of the disability;
  • additional payments for single parents;
  • educational support, including student aid through BAfoeG.

These mechanisms are handled by different authorities. A Schwerbehindertenausweis helps prove the status, but it does not replace separate applications.

Pflegegrad and care support

GdB and Pflegegrad are different systems. GdB shows the degree of disability for Nachteilsausgleiche. Pflegegrad shows how much regular help a person needs in daily life.

If a person needs help with hygiene, eating, mobility, medication, orientation, communication, or organizing the day, it is worth contacting the Pflegekasse through health insurance. The assessment is usually carried out by the Medizinischer Dienst or another expert body.

With a recognized Pflegegrad, the following may be available:

  • Pflegegeld if care is organized at home by relatives;
  • Pflegesachleistungen if a care service comes to the home;
  • combined models;
  • Verhinderungspflege and Kurzzeitpflege;
  • grants for adapting the home;
  • care supplies and Pflegehilfsmittel;
  • care counseling.

In more detail, this is connected with care insurance - Pflegeversicherung. Benefit amounts change, so check the Pflegekasse tables before applying.

Financial support and pension

Schwerbehindertenausweis is not the same as a benefit payment. Money may come from different systems if the conditions are met:

  • Buergergeld or Grundsicherung if income and assets are insufficient;
  • Sozialhilfe or Eingliederungshilfe for participation in social life;
  • Pflegegeld with a recognized Pflegegrad;
  • Erwerbsminderungsrente if the person cannot work enough hours because of their health;
  • Unfallrente if the limitation is connected with a workplace accident or occupational disease;
  • regional Blindengeld, Gehoerlosengeld, or Landespflegegeld, if they exist in the federal state.

An Erwerbsminderung pension requires insurance history and a medical review by Deutsche Rentenversicherung. In a complex situation, it is better to get advice from DRV, a Sozialverband, EUTB, or a lawyer specializing in social law.

When personal advice is needed

Seek advice if:

  • the authority refused the application or assigned a low GdB;
  • the condition worsened and you need to file a Verschlimmerungsantrag;
  • you are afraid of losing your job;
  • a child needs Schulbegleitung;
  • it is unclear what is more advantageous: a transport Wertmarke or a Kfz-Steuer reduction;
  • Pflegegrad, pension, Jobcenter, and residence law issues are all involved at once;
  • documents from another country need to be used in a German Verfahren.

For an initial orientation, EUTB, the Sozialverband VdK or SoVD, counseling through the Krankenkasse, the Integrationsamt, the Agentur fuer Arbeit, and municipal social services are often suitable.

Common mistakes

  • Submitting only the diagnosis without describing practical limitations in everyday life.
  • Expecting a foreign disability card to be recognized automatically in Germany.
  • Confusing GdB and Pflegegrad.
  • Not requesting Merkzeichen even though they are what unlock some benefits.
  • Missing the Widerspruch deadline after the Bescheid.
  • Not informing the authority about a substantial worsening or improvement of the condition.
  • Buying expensive assistive devices before getting approval from the Krankenkasse or another cost-bearing authority.

In Germany, disability status is established through an Antrag and a decision of the competent authority. GdB of 50 and above gives severe disability status and the right to a Schwerbehindertenausweis. Specific benefits depend on the GdB, Merkzeichen, work, income, Pflegegrad, and the federal state.
