A residence permit in Germany is required if a foreign national wishes to stay in the country longer than the period permitted by a visa or visa-free travel. A temporary residence permit is called an Aufenthaltserlaubnis, while permanent residence status is most often referred to as a Niederlassungserlaubnis. The basis for the residence permit determines which documents are required, whether you can work, how long the permit is valid, and how to renew it.

Residence Permit and Permanent Residence: What’s the Difference?

A residence permit is usually issued for a specific purpose: work, study, family reunification, humanitarian protection, self-employment, job search, or participation in a special migration program. This status is valid for a limited period and is renewed as long as the basis for it remains valid.

Permanent residence provides a more secure right of residence. To qualify, you usually need to have lived in Germany for a specified period, have an income, housing, health insurance, pension contributions, and demonstrate sufficient integration. The exact conditions depend on your current status: for example, the timeframes and requirements may differ for skilled workers, graduates of German universities, and family members of German citizens.

Where to Apply for a Residence Permit

If a person is still outside Germany and needs a visa to enter, they usually first apply for a Category D national visa at a German consulate. After entering the country, long-term status is issued or renewed by the local Ausländerbehörde at the place of residence.

If a person is already legally residing in Germany, the ability to apply from within the country depends on their citizenship, current status, and basis for residence. There is no universal rule that “everything can only be processed from within Germany”: some procedures begin abroad, while others continue once in Germany.

Main Grounds for a Residence Permit

Basis When it applies What is usually checked
Employment Employment contract or specific job offer Qualifications, salary, working conditions, and sometimes recognition of a degree
Education Admission to a university, Studienkolleg, or preparatory programs Admission, financing, insurance, housing
Ausbildung Vocational training Ausbildung contract, language requirements, financing, insurance
Family Reunification A spouse, child, or parent is entitled to reside in Germany Family relationship, housing, income, language, status of the inviting person
Humanitarian grounds Protection, asylum, inability to leave the country, specific medical or political circumstances Decision by the competent authority and evidence of the specific situation
Self-employment or business Planned entrepreneurial activity Business plan, financing, economic interest, experience
Chancenkarte Job search in Germany based on qualifications or a points system Qualifications, language skills, financial resources, points, or a recognized degree

This list is not exhaustive. German law includes separate provisions for researchers, professionals with an EU Blue Card, graduates, IT specialists, seasonal workers, and other situations.

Chancenkarte in 2026

The Chancenkarte is valid starting June 1, 2024, and is intended for job seekers in Germany. It is not a substitute for a work residence permit: once a suitable employment contract is found, you will usually need to switch to a different type of Aufenthaltstitel.

There are two ways to obtain a “Card of Opportunities”:

  • as a qualified professional with a recognized or comparable qualification;
  • through a points-based system, provided the basic requirements regarding qualifications, language proficiency, and housing are met.

The Chancenkarte is usually issued for a maximum of 1 year. While looking for work, trial employment and part-time work for up to 20 hours per week are permitted. If a person has found a suitable job but has not yet met all the conditions for another work residence permit, a subsequent permit valid for up to 2 years may be issued upon fulfillment of the requirements.

To demonstrate financial support, applicants are often required to show sufficient funds to cover living expenses, for example, through a Sperrkonto, a Verpflichtungserklärung, or income from authorized part-time work. The required amount varies, so it should be verified before submitting the application.

Validity Period and Absence from Germany

Residence permits are issued for a period of time determined by the basis for the permit: student status, employment contract, family situation, or humanitarian grounds. In practice, the card can be valid for anywhere from a few months to several years, but the validity period does not automatically grant the right to keep everything unchanged until the card expires. If your job, studies, marital status, address, or income changes, the Ausländerbehörde may require you to notify them or apply for a new permit.

A separate risk is a prolonged absence from Germany. As a general rule, an Aufenthaltstitel may be revoked if a person has left the country for more than a temporary period or has not returned within 6 months, unless the authorities have previously established a longer period. Exceptions apply for certain statuses and cases, so it is best to obtain written confirmation from the Ausländerbehörde before taking a long trip.

What documents are usually required

The exact set of documents depends on the basis for the permit, but the following are most commonly required:

  • a valid passport;
  • an application form and a biometric photo;
  • registration of an address in Germany;
  • health insurance;
  • proof of financial support;
  • a lease agreement or information about your housing;
  • an employment contract, Zulassung, an Ausbildung contract, a marriage certificate, or another document supporting the basis for the permit;
  • diplomas, proof of recognition of qualifications, or professional experience, if required;
  • Proof of payment of the fee.

Documents in a foreign language may need to be submitted as certified translations. Many procedures require an appointment, and in large cities, available slots are infrequent.

Procedure

  1. Determine the exact basis: work, study, family, Chancenkarte, or another provision.
  2. Check where you need to start the process: at a consulate abroad or at the Ausländerbehörde in Germany.
  3. Gather the documents listed on the official checklist for your city or consulate.
  4. Submit your application before your current visa or residence permit expires.
  5. Keep your application receipt. In Germany, this may be important if your card expires before your application is processed.
  6. After receiving the decision, check the validity period, work authorization, and any additional conditions on the card or the Zusatzblatt.

Common Mistakes

  • Submitting an application based on a general list of documents without checking the requirements of a specific city.
  • Treat the Chancenkarte as a work residence permit and do not plan to switch to a different status after finding a job.
  • Leaving Germany for an extended period without written approval from the Ausländerbehörde.
  • Changing employers, study programs, or family circumstances without checking whether you need to notify the authorities.
  • Do not wait until the last few days of your visa or card’s validity to submit your application.
  • Using outdated 2024 regulations without checking the current requirements.

FAQ

Is it possible to obtain a residence permit without leaving Germany?

Sometimes yes, but it depends on your citizenship, current status, and the basis for your application. If a national visa is required for entry, the process often begins at a German consulate abroad.

How long is a residence permit valid?

There is no standard duration. It depends on the basis for the permit, the documents submitted, and the agency’s decision. Student, work, family, and humanitarian statuses may have different durations and renewal conditions.

What should you do if your appointment at the Ausländerbehörde is scheduled after your card expires?

You must submit an application or request for renewal before your current status expires and keep a receipt confirming submission. In such situations, the agency may issue a Fiktionsbescheinigung or confirm the continuation of your legal stay pending a decision.

Can you work with a residence permit?

Only if your status permits it. Work authorization is indicated on the card or on a separate sheet. The Chancenkarte has its own restrictions on part-time work, and after securing full-time employment, you will usually need to switch to an appropriate work-based Aufenthaltstitel.
