Fiktionsbescheinigung under Section 81 (4) AufenthG
The Fortgeltungsfiktion under Section 81 (4) is the most important option for people who already had a valid Aufenthaltstitel or a national visa for long-term residence. If an application for an extension or another Aufenthaltstitel is filed before expiry, the previous status temporarily continues until the Ausländerbehörde makes a decision.
In practical terms:
- residence remains legal;
- previous work conditions usually continue to apply;
- the status can be demonstrated to an employer and other organisations;
- temporary travel abroad and re-entry are usually possible with the correct document and a valid passport.
Before travelling, check that Section 81 (4) is actually marked on the Fiktionsbescheinigung, that the document is valid on the date of return, that the passport is valid, and that the previous Aufenthaltstitel or national visa is available as proof. For travel outside Germany, also check transit, airline, and destination-country rules in advance.
Fiktionsbescheinigung under Section 81 (3) AufenthG
Section 81 (3) applies in other situations: a person is lawfully in Germany but does not yet have an Aufenthaltstitel that could “continue” under subsection 4. For example, this may concern nationals of countries whose citizens may enter without a visa for a short period and who are entitled to apply for a long-term Aufenthaltstitel while already in Germany.
There are two versions:
- Section 81 (3), sentence 1, AufenthG: the application was filed during lawful residence;

Who does not need a Fiktionsbescheinigung
German citizens do not need this document. EU and EEA citizens have the right to free movement and generally do not obtain an Aufenthaltstitel under the AufenthG. Separate rules and confirmations under freedom-of-movement law apply to family members of EU/EEA citizens, so they should clarify their situation with their local authority.
For nationals of visa-exempt countries, it is important to distinguish short-term residence from a long-term Aufenthaltstitel. The right to stay in the Schengen Area for up to 90 days does not itself mean that you may work or remain longer without a decision from the Ausländerbehörde.

- a Meldebescheinigung or Anmeldung;
- a tenancy agreement or Wohnungsgeberbestätigung, if the authority requests proof of housing;
- a current biometric photograph, if requested by the authority;

- proof of urgency if the Fiktionsbescheinigung is needed quickly.

How much a Fiktionsbescheinigung costs
The federal Aufenthaltsverordnung provides a fee for a Fiktionsbescheinigung: €13 for adults and €6.50 for minors.
